Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and The 7 Brews Menu ("we", "us", "our"), the independent publisher of https://the7brewsmenu.com. By accessing, browsing or using any part of the site, including our menu guides, nutrition tables, calculators, allergen matrix, secret-menu database and store locator, you confirm that you have read these Terms and agree to them.

Our Privacy Policy, Cookie Policy and Disclaimer are incorporated into these Terms by reference and form part of this agreement. Our Editorial Policy describes the standards we hold ourselves to and is provided for transparency rather than as a contractual promise of accuracy.

If you do not agree with any part of these Terms, the remedy is simple and immediate: stop using the site. There is nothing to cancel, because there is nothing to sign up for.

"Site"

The website at https://the7brewsmenu.com, all subdomains, and all pages, data, tools and files made available through it.

"Content"

Text, tables, data compilations, guides, editorial commentary, layout, graphics, code and any other material we publish on the Site.

"Tools"

Our interactive features, including the calorie calculator, drink customiser, allergen filter, secret-menu database, weather-based suggestion and any AI-assisted suggestion feature.

"User Submission"

Anything you send us, a correction, a receipt photo, a price report, a barista tip, a bug report or general feedback.

"7 Brew"

7 Brew Coffee and its affiliated companies and franchisees. A third party, unrelated to us, as explained in section 4.

The Site is available to anyone with an internet connection, free of charge, and requires no registration. By using it you confirm that:

• You are at least 13 years old. If you are between 13 and the age of majority where you live, you use the Site with the awareness of a parent or guardian.
• You are not barred from using the Site under the laws of your jurisdiction or subject to applicable sanctions or export restrictions.
• Where you use the Site on behalf of an organisation, you have authority to accept these Terms for it.

Our privacy policy explains that we do not knowingly collect personal information from children.

All 7 Brew names, logos, drink names, slogans and trade dress are the property of their respective owners. We refer to them only descriptively, to identify the products we are writing about, a use commonly described as nominative fair use. Our full trademark statement is in the disclaimer.

Practically, this means we cannot:

• Take, change, refund or look up an order
• Issue, replace, reload or check the balance of a gift card
• Handle a complaint about a drink, a stand, an employee or wait times
• Confirm whether a specific stand carries a specific seasonal flavour today
• Answer employment, franchising or corporate questions
• Honour or extend any coupon, reward or promotion

For any of the above, contact the stand or the company directly. Our store locator exists to help you find the right stand, not to substitute for it.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Site and its Content for your own non-commercial purposes. Within that licence you are expressly welcome to:

• Read, print and save pages for your personal reference
• Download the PDF menu and allergen guides we publish for that purpose
• Share links to any page, anywhere, without asking us
• Quote short passages or a few data points in an article, video, forum post or class assignment, with clear credit to The 7 Brews Menu and a link to the page you used
• Use our calculators as often as you like, including at the drive-thru window

That licence does not transfer ownership of anything, and it ends automatically if you breach these Terms.

You agree not to:

• Systematically copy the Site. Scraping, crawling for bulk extraction, mirroring, framing or republishing our tables, database or guides at scale is not permitted without written consent.
• Republish our compilation as your own. Reproducing substantial parts of our nutrition or pricing data, or a lightly reworded version of it. On another site, app or feed infringes our rights in the compilation.
• Train or ingest at scale. Using automated systems to harvest the Site for machine-learning datasets or generative reproduction requires our written permission.
• Overload our infrastructure. No denial-of-service, no aggressive automated requests, no stress testing.
• Interfere with security. No probing, scanning or circumventing access controls; no attempt to reverse-engineer, decompile or tamper with our code beyond what your browser does normally; no introduction of malware.
• Misrepresent the relationship. Do not imply that you, or your site, is endorsed by us, and do not present yourself as us or as 7 Brew.
• Manipulate advertising. No artificial impressions, no incentivised or automated clicking, no interference with ad delivery. This protects our AdSense standing and therefore the Site's existence.
• Abuse other people. No unlawful, harassing, defamatory or infringing use of our contact channels.
• Strip attribution. Do not remove copyright notices or source credits from material you are permitted to reuse.

Ordinary search-engine indexing is welcome and expressly permitted. Our robots.txt file states what automated agents may do; where it and this section differ for a given agent, the more permissive applies to well-behaved crawlers that respect it.

Raw facts are not ours to own, a calorie count is a fact, and nobody can copyright it. What we do own is everything we built around those facts:

• The selection, arrangement and structure of our database, which is a protected compilation
• Our editorial writing: guides, explainers, comparisons, rankings, tasting notes and FAQ answers
• Our calculation models, including how we scale syrup pumps, milk swaps, ice displacement and size variants
• Our original graphics, menu cards, illustrations and design system
• The software that powers the Site and its Tools

These are protected by copyright and other intellectual property laws and remain our property. Third-party trademarks referenced on the Site belong to their owners. If you would like to license our original material or reproduce more than a short quotation, write to us. see the DMCA and copyright page for how licensing requests are handled.

Our figures come from published brand disclosures, ingredient and supplier documentation, reader-submitted receipts and photographs, and direct verification visits. Our Editorial Policy sets out the whole method. Even so:

All Content is provided for general information and comparison. We make no representation or warranty that it is complete, current or error-free, and we are not liable for decisions made in reliance on it. If you spot something wrong, tell us. We would rather be corrected than be wrong for another day. See section 11.

The calorie calculator, the drink customiser, the allergen filter and our suggestion features are modelling tools. They apply documented ingredient values and scaling factors to the options you select and return a computed estimate.

• Outputs are calculated approximations, not laboratory measurements and not values published by any brand.
• Any AI-assisted suggestion is a generated recommendation that may be imperfect; it is not verified nutrition data, and you should sanity-check it against our tables.
• Weather-based suggestions depend on third-party forecast data we do not control.
• Data you save in a tool lives in your browser, as explained in our privacy policy. Clearing site data erases it, and we cannot restore it.
• We may change, improve or retire any Tool. We are not obliged to preserve locally stored data across such changes, so export or note anything you need to keep.

Caffeine and sugar figures on the Site are provided so you can make informed comparisons against published guidance, such as the FDA's general reference of up to 400 mg of caffeine per day for most healthy adults. Individual tolerance differs substantially, and that reference does not apply to everyone.

Reader corrections are one of our best sources, a photographed menu board from a stand we have never visited is worth more than an afternoon of desk research. When you send us a User Submission:

• You grant us a worldwide, royalty-free, perpetual, non-exclusive licence to use, reproduce, adapt and publish it in connection with the Site, including in our data tables and guides.
• You confirm the material is yours to share. That you took the photo or hold the necessary rights, and that sharing it does not breach any duty you owe to an employer.
• You accept that we verify before publishing and may decline, edit or wait for a second source. We are not obliged to use a submission or to explain a decision.
• Submissions are non-confidential. Please do not send trade secrets, internal documents you are not permitted to share, or anyone else's personal information.
• We do not owe payment for submissions, and none is implied by publication.
• We may credit you by first name or handle if you ask; by default we publish corrections without attribution to protect contributors who work at a stand.

The Site is funded by advertising, primarily through Google AdSense. That is what keeps every calculator, table and PDF free with no paywall.

• We do not control which ads appear. They are selected programmatically. An ad on our pages is not an endorsement, and we do not vouch for advertised products, claims or offers. Verify any claim with the advertiser and take disputes up with them directly.
• Advertising does not influence editorial judgement. No advertiser can buy a ranking, alter a nutrition figure or remove an unflattering comparison. Our Editorial Policy describes this separation, and the disclaimer contains our full FTC disclosure.
• Cookies used for advertising are described in the Cookie Policy, together with the controls for switching them off.
• Do not tamper with ad delivery. Artificially inflating impressions or clicks breaches these Terms and can jeopardise the Site's participation in the programme.

We link to mapping and directions services, official brand and nutrition sources, regulatory references and occasionally social platforms. We also rely on third-party services for hosting, maps, weather data and AI suggestions.

We do not control those sites and services, we do not endorse their content by linking, and we are not responsible for their availability, accuracy, security or terms. Your use of a third-party service is governed by that provider's own terms and privacy policy. Where a third-party service fails or changes, features on the Site that depend on it may degrade or stop working, and we accept no liability for that.

We aim to keep the Site fast and available, but we provide no uptime commitment. Access may be interrupted by maintenance, hosting incidents, network problems, provider outages or events outside our control.

We may add, change, suspend or remove any part of the Site, including any Tool, guide, data set or feature, at any time, with or without notice, and without liability to you. We may also revise these Terms as described in section 21.

In plain terms: we publish this Site in good faith and take real care with it, but we cannot guarantee that it is perfect, complete, always available, or right for your particular situation. Formally:

The Site, its Content and its Tools are provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory or otherwise. To the fullest extent permitted by applicable law, we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, secure, timely or error-free; that defects will be corrected; that the Site or its servers are free of harmful components; or that any Content, nutritional figure, price, allergen listing or calculated result is accurate, complete, current or reliable.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits rights you have as a consumer that cannot be limited by agreement.

Because the Site is free, informational and independent, our exposure is limited as follows.

To the fullest extent permitted by applicable law, in no event shall The 7 Brews Menu, its publisher, editors, contributors, suppliers or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your access to, use of, or inability to use the Site, its Content or its Tools, including any allergic reaction, adverse health outcome, dietary miscalculation, caffeine-related effect, price discrepancy, wasted journey or reliance on third-party advertising. Whether based in contract, tort, negligence, strict liability, statute or any other legal theory, and whether or not we were advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the Site shall not exceed one hundred United States dollars (US$100.00) or, if greater, the amount you have paid us in the twelve months preceding the claim, which for a free site is ordinarily zero.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or any liability under mandatory consumer-protection law in your jurisdiction. Some jurisdictions do not permit certain limitations, so parts of this section may not apply to you.

You agree to indemnify, defend and hold harmless The 7 Brews Menu and its publisher, editors and contributors from and against any claims, demands, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of or connected with:

• Your breach of these Terms or of any applicable law
• Your misuse of the Site, including any activity prohibited by section 6
• Any User Submission you provide, including a claim that it infringes a third party's rights
• Your unauthorised commercial use or republication of our Content

We reserve the right to assume the exclusive defence of any matter subject to indemnification, at your expense, and you agree to cooperate with that defence.

We respect intellectual property and expect the same in return. If you believe material on the Site infringes your copyright, our DMCA and Copyright page sets out exactly what a valid notice must contain, where to send it, how counter-notification works, and our repeat-infringer policy.

Notices must be complete to be actionable. Submitting a knowingly false notice or counter-notice may expose you to liability for damages, including costs and legal fees, under 17 U.S.C. §512(f).

We may restrict or block your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms. Most commonly for scraping, attempted intrusion or ad manipulation. Because there are no accounts, this is usually enforced at the network level.

You may end this agreement at any moment by ceasing to use the Site. Sections that by their nature should survive termination do so, including sections 7, 15, 16, 17 and 20.

Governing law

These Terms and any dispute arising from them or from your use of the Site are governed by the laws of the State of Arkansas, United States, and applicable US federal law, without regard to conflict-of-laws principles. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-protection rules of your country of residence.

Talk to us first

Before commencing any formal proceeding, you agree to contact us at the7brewsmenu@gmail.com with a description of the dispute and the resolution you are seeking, and to allow 30 days of good-faith discussion. Most issues about data accuracy or attribution are resolved this way within days, and we would genuinely rather fix a page than argue about it.

Venue

If the dispute is not resolved informally, you and we agree to the exclusive jurisdiction of the state and federal courts located in Arkansas, and each party consents to venue there. You retain the right to bring a qualifying claim in a small-claims court in your own locality.

Individual claims

To the extent permitted by applicable law, claims will be brought in an individual capacity and not as a plaintiff or class member in any purported class, collective or representative proceeding. Where such a waiver is unenforceable in your jurisdiction, it does not apply to you.

Time limit

Any claim relating to the Site must be brought within one year after it arises, except where applicable law prohibits a shortened limitation period.

Entire agreement

These Terms, together with the policies incorporated by reference, are the entire agreement between us regarding the Site and supersede any prior understanding.

Changes to these Terms

We may revise these Terms at any time. The "Last updated" date at the top of this page always reflects the current version, and continued use after a change constitutes acceptance. For material changes we will make the update prominent on the Site for a reasonable period.

Severability

If any provision is held unenforceable, it is modified to the minimum extent necessary or severed, and the remaining provisions continue in full force.

No waiver

Our failure to enforce a provision is not a waiver of our right to enforce it later.

Assignment

You may not assign these Terms. We may assign them in connection with a transfer of the Site, in which case we will note it on this page.

Force majeure

Neither party is liable for failure to perform caused by events beyond reasonable control, including outages, natural events, labour disputes or government action.

No third-party beneficiaries

These Terms create no rights for anyone other than you and us.

Headings and language

Headings are for convenience only. This agreement is drafted in English; where a translation conflicts, the English version governs.

No agency

Nothing here creates a partnership, joint venture, employment or agency relationship with us or with 7 Brew.
